The FDA is not declaring walnuts illegal, but thy are saying that Diamond cannot make health claims to market their product unless it goes through the FDA approval process for a drug, because that is the FDA's mandate, to make sure that any substance advertised to have a health benefit must go through their approval process.
All Diamond has to do is stop making health claims in their advertising to get around this. They could just start a viral campaign saying that walnuts are good for you, but that wouldn't benefit their brand of walnuts specifically, so they chose to fight the mandate rather than just educate consumers that any walnuts are good for you. :}
